Terms of business definitions
We/Us/Our: shall mean Top Dog Paintball Ltd, registered office, Ringland, Norwich, Norfolk, NR8 6RJ.

Purchaser/you/your: shall mean the person who makes the individual or group booking on behalf of the individual or people in the group.
Participant: shall mean an individual taking part in an event who may or may not be the purchaser.
The event/booking: shall mean the paintball activity provided by us.
Activity: shall mean the paintball event
Book in/booking in/booked in: shall mean the time that participants sign and hand in their disclaimer registration forms on the day of the event.
Special offers: shall mean any discounted rates that we have in place at certain times for paintball events on our site.
The booking process
You may make a provisional booking by telephone or in writing, you may also enquire about availability by email. To confirm a booking we will need to receive a £10.00 deposit per person 2 weeks prior to the event date. The balance is then payable on the day of the event.
In completing such details, You warrant that You have been duly authorised by or on behalf of other people, party or entity so stated, and they have agreed to be bound individually and collectively by the within written terms and conditions. Subject to satisfactory details and receipt of the appropriate deposit as set out hereafter. Upon receipt of deposits, we will send you written conformation. A binding contract is in force from receipt of the initial deposit on the within written terms and conditions.
These terms and conditions will supersede all previous terms and conditions issued or given verbally.
Any special offers that we have in place at the time of booking, must be pre arranged by you at the time of booking in at the latest. Once you have booked in, no special deals added on or changed by you or our staff.
The event process
On the day of your paintball event, all participants are required to arrive at the site half an hour prior to the event start time which is specified on our booking conformation. During this time all participants will be required to fill out a disclaimer registration form provided by us. Any incomplete or unreadable forms will not be accepted and may result in a delay of your scheduled paintball event or refusal of the event. After booking in you will be issued with a number, the reason for this being explained in the safety briefing.
Upon book in, all participants must redeem any special offer vouchers, these vouchers or special offers cannot be added once you have booked in and full price will apply.
By signing our disclaimer registration form, all participants agree to the following rules.
You will acknowledge that we will not be held liable for accidents that may happen on our site unless we have failed to undertake reasonable steps to carry out our duty of care.
You acknowledge that we will not be held liable for loss or damage to any personal property, i.e. vehicles, clothing and valuables etc.
You understand and recognise that there are natural hazards within our paintball site, such as rabbit holes, fallen branches and uneven terrain.
You will not be under the influence of any drugs or alcohol, before or during the paintball event. We reserve the right to remove any participant who we suspect to be under the influence of drugs or alcohol with no refund given, and all balances to be paid in full prior to departure from our site.
You will comply by the rules that will be explained to you during the safety briefing, you will use the equipment provided by us, only as instructed in such a manor as to not injure or harm other participants. You will adhere to all rules and directions given by our staff.
If you are not able or willing to adhere to our code of conduct, rules and directions then you will be unable to continue in the participation of the paintball event without refund and you may be asked to leave our venue.
During the paintball event, whilst you are out in the game zones, you will at all times wear goggles provided by us or goggles which meet the required BS standards supplied by you. Once outside the designated safe zone, you will never under any circumstances deliberately shoot anybody in the face or head area.
During the paintball event, whilst you are out in the game zones, you will use paintball markers provided by us. You will be allowed to bring and use your own marker, only after it has been deemed as safe by a member of our staff and after it has been fired over our chronograph, regular checks of your marker can be carried out at any time.
You accept that we reserve the right to make the appropriate charges to you for any deliberate or accidental damage to or the non return of equipment that we have provided to or used by you. You agree to pay these charges in any such event. You agree that any goods or services provided to you, will be paid for in full prior to departure from our venue and you are aware of such costs that are displayed at our venue.
You are aware that any unpaid accounts due to dishonoured cheques or credit card payments will be subject to the following charges: 5% interest per month, £10 per letter sent to you and £5 per telephone call made by us in pursuit of unpaid accounts. You are aware of the payment methods accepted by us.
You are aware that photographs will be taken during your event and these maybe published on our website and they may also be used in future marketing and promotions of our company, free of charge.
You are aware that we will not pass on your personal details to any other company but we may contact you from time to time to inform you of any special events or offers.
By participating in a paintball event at Top Dog Paintball Ltd, or visiting our venue, you hereby release, remises and forever discharge from any claims or liabilities whatsoever without limitation that you might have against us or our employees, the owners of the property in which the activities take place and any other participant taking part in the activities.
Deposit/security
All booking confirmations are subject to us receiving from you, the deposit of £10 per participant . Once your booking has been confirmed by telephone and deposits have been paid then your right to cancel without penalty ends as designated by the office of fair trading, by us booking you into a sporting event at a specific time and date. Once your booking is confirmed, all deposits are then considered as non refundable and will be held, should you need to cancel your event date, we will offer another event date at your convenience. All deposits for our venue are due 2 weeks prior to your event date. As an alternative we can offer you a gift voucher for the full amount paid which will be valid for 12 months. Top Dog Paintball Ltd accepts the following methods of payment.
Cheques: Deposits and payments at the event should be made payable to us Top Dog Paintball Ltd.
Credit/debit card: Deposits can be made by you the participant over the telephone, and payments at the event by means of credit or debit card.
All balances due on the day of your event will be paid prior to activities commencing, these can be made by cash, cheque (accompanied by guarantee card), or any major credit or debit card at our venue.
If full deposit amount is not received by the date we specify when you make your provisional booking then we reserve the right to cancel your provisional booking.
Cancelations and refunds
You must notify us immediately either in writing or by telephone of cancellations. Charges apply as follows.
If more than 7 days prior to your event date, all monies received will be held for a future scheduled event, if you have booked using one of our voucher schemes, the voucher will be honoured for a future scheduled event. As an alternative we can offer you a gift voucher for the full amount paid which will be valid for 12 months.
If you cancel within the 7 days prior to your event date. All deposits paid are forfeited for cancellation fee, if you have booked using one of our voucher schemes the voucher will be forfeited for cancellation fee, if you wish to rebook using the voucher, the voucher price must be paid again to Top Dog Paintball Ltd direct. Monies taken for extra paintballs will be held for a future scheduled event.
Refunds will not be given to you for any unused paintballs.
Venue availability
Unless otherwise notified, paintball activities are offered all year round 365 days of the year, subject to availability and customer demand.
By using our venue and facilities you automatically agree to be bound by our conditions and to comply with all of our directions and requirements to include (without any prejudice) any such regarding safety and cancellations. Events may be cancelled due to adverse weather conditions, or other reasons beyond our control. We cannot be held liable for any costs incurred by you when we cancel any event at short notice.
If you wish to make changes
If you need to make any changes to the status of your booking, we will try to honour these changes if you inform us up to 2 weeks prior to your event date, this may include group size, type of booking or type of package required. please note that we cannot guarantee to honour these changes and also if the group size changes then the final price of your booking will also change and if more deposits are owed these must be paid. Any bookings made within 2 weeks of the event date, your details and requirements are to be advised and deposits must be paid to us immediately and will only be changed if circumstances permit us to do so.
Once participants are booked in on the event date, no changes may be made apart from an upgrade to a different package.
Changes made by us
We reserve the right to make changes or cancelations to any paintball activity affecting your event or any part of it, at any time due to circumstances beyond our control. You will be informed of any such changes in the first instance. You will be entitled to a credit for the value of your booking against a future booking.
Personal insurance
It is your responsibility to take out personal accident insurance for your own protection which should include insurance against the cost of cancellation by you and to cover you for medical/treatment due to an accident or illness. Due to the uneven terrain, paintball activities may present an element of risk. We do not offer such insurance.
We cannot be held responsible for any injury or loss suffered by you other than explained in these terms and conditions. We recommend that if you decide to take out personal insurance that it covers you for the activities you wish to participate in.
Our liability
Subject to any statutory exclusions.
We shall not be liable to you in contract, tort (including without limitation negligence) an/or breach of statutory duty for any loss or damage which you may suffer by reason of any act, omission, neglect or default (including negligence) in the performance of these conditions by us, our staff in a sum which is greater than the Booking price of the event.
We will not be responsible for any injury, illness, death, loss, damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:
The act(s) and/or omission(s) of any person(s) affected or any member(s) of your party; or
The act(s) and/or omission(s) of a third party not connected with the provision of Your arrangements and which were unforeseeable or unavoidable; or
Force Majeure
Personal disclosure/restrictions
It is your responsibility to inform us of any material matters that may affect our services and health and safety. Paintball activities at our site has a minimum age restriction which is 16, so all participants must be 16 and above. If you have an existing medical condition, allergy, or disability which may affect participation you must inform us at the time of booking the event. If you fail to inform us at the time of booking, we reserve the right to cancel the booking and impose cancellation charges. Participating in paintball events may have a small element of risk or danger and therefore participation is at your own risk.
Health and safety
You agree to comply with all our instructions in relation to paintball activities relating to any one event to the intent that our venue is deemed safe and that your event may be safe and enjoyable.
Paintball activities may have a small element of risk and danger, whilst we do take all reasonable precautions, we stress that you participate at your own risk. If you have any medical condition which maybe affected by participating in paintball activities, such as back problems, knee/ankle injuries or pregnancy, please consider if such an activity is suitable before booking.
Unacceptable behaviour
We reserve the right to stop your participation in a paintball activity in the whole or part of, if in our opinion you are violent, abusive to staff or other participants, unruly, under the influence of alcohol or drugs, where your behaviour is likely to endanger the safety of or enjoyment of other participants. Any participant found to have unacceptable behaviour will be removed from activities or from the site, with no refund given and any balances due will be paid before departure from our venue.
Events beyond our control
In the unlikely event of adverse weather conditions or other issues beyond our control, an event maybe cancelled, or delayed. In such an event we would offer you an alternative date for your event or a credit towards a future booking. We will not be liable for any travel or accommodation costs incurred by participants in such circumstances.
Special offers
Special offers cannot be used in conjunction with any other offer unless otherwise stated on promotional vouchers or through direct correspondence with us.
Special offers must be redeemed at time of booking the event or during booking in on the event date.
We reserve the right to withdraw any special offers at any time without formal notice. Any changes or amendments will be published on our website or in our booking conformation.
Complaints procedure
If you wish to make a complaint then you must do so within 30 days of your event date in writing by post or email. In the event of any complaint we will do our upmost to resolve the issue promptly. We will not deal with any complaints that do not follow this procedure.
Contracts (rights of third parties) act 1999
Nothing in this agreement shall confer on any third party any benefit or right to enforce any terms of this agreement.
Jurisdiction
This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between You and Us or our suppliers.
